(I) there are not sufficient workers who are able, willing, qualified (or equally qualified in the case of an alien described in clause (ii)) and available at the time of application for a visa and admission to the United States and at the place where the alien is to perform such skilled or unskilled labor, and

After over a decade of hearing the same soundbites nothing seems to have changed vis. Ron vs Wadhwa:

Ron trying to protect American jobs and keeping them for US workers .. Wadhwa trying to maintain the H1-B status quo for getting quick, cheap access to labor  !!

Unfortunately for Ron US student enrollment and completion of program rates in STEM play in Wadwa's favor as the majority in grad. and Ph.D programs over the last decade are foreigners(mostly from India and China). Add to it the out sourcers who manage to slip in under the radar using this process(H1,L1 etc) under the garb of free trade. The most hilarious phenomenon is the Indian housewife who also cleans out a few dollars from US IT firms as the status quo remains unchanged while the government as usual bumbles along with no clue as to how to solve this issue and the larger one of (illegal) immigration.

The effects of this though are pretty clear .. high unemployment in the US and stagnant wages.
Wadwa seems to have no examples as to what firms these so called "talent" forced to go back are setting up when they go back to India, China or wherever they came from and how these "firms set up by returning talent" are competing globally and against US ones. Cant think of a single quality Indian or Chinese brand that comes to mind !! So Wadhwa is definitely pulling a fast one and surprising that he has not changed his tune over the years !! He just wants cheap,pliable labor to get the grunt work done quick !!

I keep waiting to see something impressive come out of this guy but he just never delivers. SSDD.

Really - you'd think NASSCOM could come up with someone with a degree of intellect that can think on his feet. Few and far between in india however; nobody understands reasoning. Immigants did not make this country what it is - Americans did. 84% of the current US population was born here. Which demographic was it from 1978-1998 that built Silicon Valley? 98% white American males. The Indiots and everyone else didn't start arriving until late 1998 - a mere 13 years ago. 1990 - H-1B started huge recession 1991-1993

My advice is: record it at work when it happens, put it on YouTube so we can prove it, then walk out and drop the whole project in their laps wothout training anyone. The slumdogs can't do the jobs without us training them. If we refuse, corporations won't want to use them. Tell your boss to shove it and just walk out without a word. Just quit on the spot.

America is effectively being used as a continuous jobs training program for the rest of the lazy world.

Anyone can walk into the US with a conjob business plan, go to some VCs and take their $, pay lots of foreign workers with OUR VC, and then when the $ runs out, just close up shop and go home. OUR $ gets sent overseas, FOREIGN workers get paid (and send their $ home too), and the only thing the USA gets out of it is A DESTROYED ECONOMY AND STOLEN CAPITAL.

If there are successful Indian companies out there, I'd sure like to know their names and the names of their founders. And I'm not talking about the corporate griftology rackets like Wipro/Tata/InfoSys who clean out our companies (which we then have to bail out), and produce nothing.

How did US companies "survive" back in the 90s before Indians began flooding the US? Not only did they survive, they thrived. So did Americans and so did the US economy.

Like Intel, AMD has failed to gain traction in increasingly popular mobile gadgets like Google Inc's Android smartphones and Apple Inc's iPad, which some people are buying instead of laptops.

Read, who was a top executive with PC maker Lenovo Group Ltd, replaced Dirk Meyer, who left in January partly due to differences with the board of directors over the company's mobile strategy.

Dude, you have said this before. I realize that you're trying to be on our side, but what you propose is tantamount to saying that foreign labor arbitrage will end when Americans adopt their own labor arbitrage.

The market takes care of itself.  Education is an investment. Like any wise investment, one should invest in something that will provide a good return on that investment. The only reason that Americans haven't been majoring in tech right now is that the prospects of getting good paying job are slim or none.  That's not a wise investment.

Compared to finance or health care, tech is a pretty risky proposition for somebody choosing a major right now.  Besides, we STILL have lots of people majoring in tech anyway, not because it's a good investment, but because they love it, yet those people AREN'T FINDING JOBS either.

As I said before, this whole "retraining" argument has been bogus from the start. It was profferred as a "solution" to a "shortage" that never existed, to placate those who would not like the idea of bringing in foreign workers, as a means of persuading them that the foreign workers was only a temporary solution, so as to more easily gain their acquiescence.  It's a red herring, a shill argument, a big pile of doo doo.

The first lie in their argument is the idea that "there is a labor shortage." Just try googling any kind of job you can think of, policeman, fireman, postal worker, teacher, doctor, lawyer, milkman, anything, and append the word "shortage" to it.  You will get over 100,000 hits. The truth is that in a free market in the absence of a full-scale war, THERE IS NO SUCH THING AS A LABOR SHORTAGE.

If there are total 100 job openings from 100 companies willing to pay 75k for  smerchendorfers with 3.5 years of experience and burmeister's degrees from cloverleaf university, but there are only 80 such people available, THAT IS NOT A SHORTAGE.  That is merely supply and demand. Assuming that none of the would-be employers are willing to budge off the 75k price level, they will have to compete for those 80 available employees based on some other criterion such as benefits. Ultimately, 20 of those companies will have to DO WITHOUT.

Only when one things that jobs are these quantized beasts that are as discrete as atoms, and that the pay for each job is handed down from God, can one think that there could be any such thing as a labor shortage.

Please, please, please try to understand that cranking out more tech grads is only increasing labor arbitrage.  You cannot create value without scarcity. Doctors earn more money because they are SCARCE, and for no other reason.  While most Americans (and Canadians for that matter) work under the shield of protection from foreign competition on their own soil, the tech sector has been SINGLED OUT to have that protection removed.  THAT is the unfairness!

If the government were to remove the shield from everybody, that would be fair, but they wouldn't do that lest they plan to next flee the country before the revolt.  Only by taking the umbrella away from the tech minority are they able to fool the majority into going along with it.

The analogous case would be where India took the money, but the US government is the one who left it out there for them to take.  That's what I meant by "we can hardly blame the Indians." Yes, they are guilty, but firstly we were stupid.  There will always be thieves, but that doesn't excuse leaving the doors unlocked. That's why we need to look to our own government first... first let us lock the doors, and not leave our money on the back porch, THEN we'll address those thieves who resort to breaking and entering (such as illegal aliens).

R. 3012 introduced by Lamar Smith and Co.  to eliminate per-country limits for green cards for employment ?  It has passed the House Judiciary committee.  If this bill passes the house/senate,  there will be many more green cards for Indians / Chinese.  All other countries will be shut out and IT companies will become fully Indian.

Are you aware of this bill H.R. 3012 has passed the House Judiciary committee. The bill eliminates per-country limits on employment green cards.  If this bill passes the house/senate,  India/China will get many more green cards and all other countries will be shut out. You've made great points like labor scarcity, stupidity (or corp. greed ?) but both alternatives do not work in favor of US citizens currently i.e do not enter STEM it's gonna or is outsourced - results in more H1 or other visa petitions - or like I suggested enter in mass numbers which may result in local arbitrage. But what I meant by mass numbers was to catch up with what Corp. America was putting out in the 90's as shortages like 1 Million in IT etc but not so much as to flood the local market.

In the meantime have you kept tabs on the overseas staff headcounts of IBM, Oracle, Accenture, Deloite and the likes ? It's grown exponentially and under the radar.

So there is no doubt that even in this economy of 20%+ real unemployment firms have positions that they cannot fill - hence the need to fill with foreigners who may or claim to have the skills. Corp. America has to churn profits at any cost - whether it be on the backs of locals or imports ! But locals are losing out big time with this current status quo ! A proper labor market test to see where the shortage is may help but doubt govt. is capable or has the will to enforce due to lobby pressures. Re-training has proven to be a failure (and the odd rare cases where it has worked may surface) again due to lack of will and the easy availability of imports from the third world !

Regarding toilets,  there are not many public toilets in america either  except few on side of highway streched 50 miles apart.   Only restrooms you can go to are convenice stores, mcdonalads , grocery store etc.    Same like in india.  
First world country like america has poorest public transportation in this world.  If your car broke down or unable to drive , taxis are very expensive.

One of those "exceptions" that are "provided" in chapter 12 is H-1b, and another is the EB visas. Without those US government statutes, the Indians, and all the other non-immigrant alien tech workers, would not be here, and would never have been here.

It was OUR government who left our money on the back porch.  If you paid for the protection, shouldn't your first argument be with those you paid, and not the people who took advantage of your protectors negligence?

Please... read ALL of what I said several times, then pause and consider. You're still bringing up the concepts that I said are either irrelevant or mythical, such as "shortage," "corporate need," "positions they cannot fill," etc., without addressing my underlying points.

Imagine the game of hide and seek, subtly altered by the government to make it "more fair."  Suppose we change the game so that if the seeker cannot find the hiders, then he will be given an alien hider.

That's exactly what they're doing!  How are the existing hiders supposed to win that game?  They can't. That kind of change to the rules is wrong, inequitable, and corrupt, but that's preciseley what they did.

Employers can ALWAYS claim that they have "unfilled positions" for which "no 'qualified' and 'interested' US worker is available, by making the position requirements ever so specific, and by being extremely unflexible as to minor discrepancies.  They can claim that they asked for somebody with 5 years experience in underwater basket weaving, but if somebody with 5 and 1/2 years applies, they can reject the person as "overqualified," while maintaining the claim that "they can find nobody 'qualified.'  Employers do this routinely.

Meanwhile, the courts have somewhat upheld the "employers right to be as specific as they like" in their requirements for prospective employees.  But the point that even the COURTS have missed is that the employer's right to be specific stems from the employers right to HIRE NOBODY AT ALL. The equitable flip-side of that right is that if the employer is too specific, then they MAY HAVE TO DO WITHOUT.

But in 1990 we changed the law so that employers will be given the opportunity to look outside the US if they can SHOW that they cannot find anyone for their ever so specific requirements, without having to justify their requirement that a software developer should also needs to be able to play the sitar in order to qualify for the position (and no they are not willing to substitute the ability to play the guitar).

But it seems, ezgoer, that you are arguing in favor of actually trying to meet the employer's evermore specific requirements? Or do you actually believe that they would hire the qualified Americans if they could "find" them? Please say it ain't so.

If you own a convenience store and someone busts in and robs you and the cops don't get there in time do you go to the gov't and tell them you want your taxes back because they didn't do their job? No, you eat the loss and live with it. Our gov't is partly to blame, I agree, but so is India and NASSCOM. They're the ones who deceived the nation by buying "worker shortages" news stories from US PR firms in 1998. They're also the ones who go around bribing our govt and even biz execs to allow this. So yes our govt is corrupt and partly to blame but it is India who has brought this corruption to the US.

And it is a logistical impossibility for any gov't to enforce these laws and deportations of 10s of millions of criminals. The govt thought they were getting honest people, instead they got 10s of millions of 3rd world criminals who didn't go home when they agreed to - so both parties are to blame. Don't you dare try to absolve India of all wrongdoing just because our govt is incompetent.

Yes and no. Depends on the firm .. most American firms at least in the 90's did not go out of their way to hire Americans if they could get a visa hire. Then after the dot com bust some reverted to hiring Americans but by then the outsourcing model was firmly in place and the Nasscom firms turned up with large American contracts. Also American firms like IBM went into India, Phillipines etc etc and set up shop thus totally destroying any career prospects for the US techie. So I see your point in no US students majoring in STEM but then have they totally given up and should not as the high paying jobs are going to foreigners both within the US and outside. Some like Jack Palmer even joined Infosys and the final outcome of that remains to be seen. Very unlikely that visa programs will stop or outsourcer model will go away soon. Thus the US techie can only watch the slow destruction of the industry !!

We're now selling our most advanced plane, the F-35 to India who will promptly dismantle it and sell it and how it works to China, Russia, and anyone else who will pay them. The indian outsourcing racket has forever ruined the image through inexperience, misrepresentation, cheating, fraud and nepotism. The government is taking steps to discourage corporations and make it difficult to go this route.

Each of the indian temp worker firms - one by one are being brought down by scandal. Its only a matter of time now before the US Government brings Infosys to destiny. There WILL be more in the future, because indians don't understand anything other than cheating and corruption. It's ingrained in the culture and this is why india won't ever get anywhere. The Indian out. model is today's IBM's business model and of Deloitte, Accenture, Oracle Support, HP Consulting Services etc etc. Way system is structured right now bet Infosys gets a slap on the wrist with a small fine in the Palmer case. This is because you can still get grunts for a third of the wage in third world countries and like a case of apples some will be bad. But you underestimate the motivation of third world grunts who want to move up the food chain so they're productive too and when they move to say the US. Yet to see Corp. America move away from the path of easy money.
