Not many takers for H1B visas

WASHINGTON: Applications for H-1B work visas, once most sought-after among Indian IT professionals, have not even reached the 50 per cent mark of the Congressional-mandated quota of 65,000, US officials have said, amid India’s concerns over the fee hike for the scheme.

According to the latest figures released by the US Citizenship and Immigration Services (USCIS), just 29,700 people had applied for H-1B visas till August 13.

Till two years ago, the cap for both the categories of H-1B visas was reached within the first few days and USCIS had to resort to computerised draw of lots to decide the successful applicants.

The low-key response this year comes amid India’s concerns over the hike in H1-B and L1 visa fee, which would adversely affect Indian IT companies.

“We are in touch with the Indian Government and are trying as best as we can to answer the questions they have about this new law,” a senior US official, familiar with the ongoing Indo-US talks on this issue, said.

Union Commerce and Industry Minister, Mr Anand Sharma, had last week also written a letter to US Trade Representative, Mr Ron Kirk, on the issue.

Under the $600 million border security bill signed into law by President Barack Obama, nearly $550 million would be raised by increasing the fee in the categories of H-1B and L1 visas for the next five years, which would mostly impact Indian IT companies . - PTI

A Suwanee-based consulting firm will pay nearly $1 million in back wages and interest to 135 temporary foreign employees who worked under a federal visa program, according to an agreement with the U.S. Department of Labor.

The Labor Department said Smartsoft International Inc., which admitted no wrongdoing, violated the rules of the H-1B program, which allows companies to hire foreign workers in specialty occupations for a maximum of six years. A Labor Department spokesman said the positions were skilled, professional jobs. He did not know the period of the workers' employment.

An investigation by the Labor Department's Wage and Hour Division found that some workers weren't paid at the beginning of their employment. It also found that some were paid as part-timers even though they were hired under a full-time agreement. And some were paid less than the prevailing wage in the geographic areas where they worked.

"Workers deserve to receive the full wages for which they have worked so hard," Labor Secretary Hilda L. Solis said. "This is not just a matter of decency and common sense, it's the law."

Smartsoft said in a statement that it feels it would have won a legal battle but that because of the cost of such a challenge the company decided to settle. The firm said the government found no systemic violation of the law and no willful wrongdoing, and that the government, not its employees, initiated the investigation.

Smartsoft attributed the dispute to "differing interpretations of highly complex laws."

According to its website, Smartsoft was established in 1997 and has more than 650 employees worldwide.




A major shitstorm has errupted over TechCruch after Madhu Yarlagadda, who was hired by Skype as Chief Development Officer by Skype last month, had his bur ki chatani wife send a threat of legal action against TechCrunch if it would not remove comments critical of this slumdog.  Skype promptly shitcanned Madhu after they found out that he was trying to get anybody and anybody to flood TechCrunch with bullshit comments designed to him make him look good.

WTF is wrong with these people?  Why do they come to this country, and then expect to inject their vile culture into our world?  If someone posts shit on an blog, the best way to promote that shit (as Apex has found out) is to:

a.  Have your slumdog wife write a legal threat in Hinglish

b.  Blast an email to everyone you know asking them to shill for you

Thank god Skype has the sense to realize that they were dealing with a upper-caste scumbag, and shitcanned this bahen chod before he could begin his mission of ethnically cleansing non-Indians at Skype.

I was going through my web logs, collecting info about the scumbag slumdogs that are posting harassing comments on my site, and came across this nugget from 2005.  Look at how these filthy jackals live!  WTF?  And this is what that pussy Vivek Wadhwa promotes!

In June 2005, I got the opportunity to visit a programmer friend working for the International Business Software Solutions, Inc., also known as IBSS. This company hires and trains software consultants. The consultants then work on projects for various U.S. companies.

You know, what struck me was the lengths at which these consultants go to secure a project at a U.S. company. This may include fake experience on their resumes, fake references, and even fake degrees! In today's economy, many IT companies in the US are hiring only American trained software professionals, and some of these consultants even develop fake accents for their phone interviews!

During the 1 week I spent at IBSS, I remember a typical 'hunt for a project': One guy, Kabir, got invited for a telephone interview. However, the interviewing company suspected that this guy was located in India, due to his heavy accent! Anyways, the company asked for his *US cellular number*, which fortunately, Kabir provided. Kabir even provided fake references - one of which included a friend. Furthermore, Kabir also read things off his resume, which he didn't have any idea about. The interview went fine, but, Kabir didn't get a position at the interviewing company. They told him he was not up the their technical expectations.


I found my friend living at the IBSS "Guest House", an 2-bedroom apartment holding 6 men. All these men had a few things in common: They were Indian and were promised a large salary at IBSS. The guest house apartments are located at Deer Creek Dr., Plainsboro, NJ. The consultants were promised a high paying project with the company, and yet, they were simply playing the waiting game. I felt very sorry for them. I was talking to one guy - his name was Aniketh. Aniketh was a project supervisor at IBM-India. He was promised a very high salary at IBSS. Unable to resist a chance to live and work in America, Aniketh resigned from his job in India (Yup, IBSS hired consultants with the stipulation that the consultant resign from his previous job!). However, in America, things were very different. After IBSS issued a H1B visa for Aniketh, he was asked to look for his own project, until then, the company would pay him $20 per day and a free stay at the guest house. 7 months had passed, and there was no sign of a project. Why should he get a project? The IT industry in the US in down in the pits. The handful of companies that are hiring only hire US trained programmers.

BTW, these IBSS motherfuckers are still in business, although not for long, thanks to the Neufeld Memo that makes their business ILLEGAL.

I am sure, like everything else out of this slumdog shill's mouth, this story is also bullshit:

“As I mentioned in my last email, I gave the lunchtime keynote at the ImmigrationWorks  conference in Seattle on Thursday,”  Wadhwa wrote. “One thing I didn’t say in my e-mail, at the request of the FBI, was that speakers to this event received letters telling them that if they attended ‘the biggest gathering of traitors of the century,’ they would do this ‘at their own peril.’”

To bolster the threat, Wadhwa pointed out:

“Attached to the letters were M1 bullets (a carbine used in semi-automatic weapons by government and paramilitary forces). Security at the event included FBI agents and Seattle police in plain clothes, and a big bouncer at the door.”

Now, of course I wouldn't be so reckless as to send a real death threat to Vivek, much less one with a round of ammo.  But I cannot confirm nor deny that some other insurgent, perhaps one that had to train his slumdog replacement, and maybe lost his home, actually was pushed to commit such an act.  What a damn warrior, that guy.

Too fuckin' bad. Vivek.  That is the price you must pay for denigrating the American IT worker.  You should be prosecuted for not registering as a foreign agent of the IB. 

I hope the next M-1 round finds it mark.

Some displaced employees who were shifted to other, lesser-paying jobs may not be counted as laid off, even if they didn't last with the company in their new roles.

That was the case for Dave Bolock, one of about 50 PwC employees told in January that their jobs in Tampa were being eliminated.

Bolock, an Oracle database administrator who worked 11 years for the company, initially stayed to train his replacement with Indian outsource firm Infosys.

"Our goal was to make the people from TCS (Tata Consulting) and Infosys look good," he said.

Now working on contract for CVS Caremark in Pittsburgh, Bolock figures about 20 of the 50 in his outsourced group took other IT positions within the company. "And all of those 20 will be gone with this round," he predicted. "Anything outside of management, they've been trying to find a way to send it to India."

It looks like notorious slumdog bodyshop WiPro is set to destroy another American IT project.  This one involves Baxter Healthcare.  The idea of some slumdog getting near my medical data just makes me want go commit some workplace massacre at the nearest curry den. 

Some insider has been sending around this urgent plea to Baxter's board:

Dear Board of Directors

I need to inform you about the travesty that is happening right now to Baxter's Enterprise Software infrastructure at the hands of WIPRO.

As the board of directors, you truly need to understand the devastating impact this will have on Baxter's customers and ESPECIALLY the impact that is about to happen for the US phase of the project that will go live in July of 2011.

1. Very limited technical knowledge - No understanding of the importance of the processes that they are working on, be it customer orders, home patient orders or invoicing and limited knowledge of the tools they are using.

2. No business knowledge whatsoever. - complete lack of understanding when it comes to how customers place orders, get the goods shipped and how they pay for orders.

3. Complete disregard for testing - They never test anything and even worse, when they make any changes, they never check that what they changed causes serious issues.

While there may be very competent Deloitte and Baxter employees checking what Wipro are doing, this is the biggest risk to the whole backbone of Baxter's Enterprise infrastructure and the longer this goes on the worse it gets.

4. All Wipro resources who worked on Canada will not be working on the US project - every single developer for Wipro that worked on the Canada project will NOT be working on the US project as they are being assigned to other projects . This goes to show the complete and utter lack of understanding by Wipro of everything that was learned from the Canada phase. All that knowledge will be lost.

5. Cardinal are trying to remove Wipro - check with Cardinal Healthcare who have already realized the damage of Wipro and are attempting to drastically reduce their dealings with them.

Based on fact 4 alone. You CAN sever ties with WIPRO and salvage the US project before it goes too far with Wipro, as they are going to be using all new people anyway.

Why not inform the CIO that you would like Wipro removed to prevent any further damage to this great company and protect any future impact to your customers and employees who will keep the proud name of Baxter from being tarnished any further by the fraudulent behavior of Wipro.

I urge you to prevent any further damage to this great company.

It looks like Cardinal Healthcare has already managed to kick the WiPro maggots out.  Hopefully Baxter will do the same.

One of my favorite bloggers, Pamela Geller, had a great post about the challenges of standing up to tyranny.  So good, in fact, that I am going to hijack it and replace her Muslim-centric terms with my own:
